Many parties opt for mediation as a cost saving mechanism to resolve their disputes and to finalise a divorce in a much more cost effective and speedy manner. We often find that a party will choose to mediate if he or she wants to dictate the outcome of a matter, and that they are not genuinely interested to mediate and rather want to dictate.
Mediation only works in divorce matters where:
- The parties trust each other to disclose all assets and liabilities
- They can communicate with one another without constant conflict
- They are both willing to compromise to a degree in order to reach a workable agreement
Mediation in divorces do not work if:
- The parties are dishonest and disrespectful towards one another
- There is a history of abuse and narcissism
- Either or both parties do not want to budge in order to settle
Advantages of Mediation:
Parties that are able to mediate are normally able to co-parent after date of divorce. Parties take control of their own matter and the speed at which it is settled.It should be cheaper than litigation and much faster to finalise. Both parties establish a sense of control over their own finances and the outcome of their matter.
